These Terms of Service ("Terms") govern your access to and use of the RecordMyBrowser browser extension and related services (collectively, the "Service") provided by Carson Fisher LLC, an Illinois limited liability company ("Carson Fisher LLC," "we," "us," or "our"). By installing, accessing, or using the Service, you agree to be bound by these Terms.

By clicking "I Agree," installing, or otherwise affirmatively indicating your acceptance before using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use the Service.

Note: The installation process for browser extensions may include a confirmation dialog or prompt. By completing that process, you are providing affirmative consent to these Terms.

RecordMyBrowser is a browser extension that allows you to record browser tabs, windows, or screen areas with audio and webcam support. All recordings are stored locally on your device. Recording capabilities may be limited by your device, browser, or operating system.

Use of the Service is also subject to Google Chrome Web Store Developer Policies and Terms of Service. Carson Fisher LLC is not responsible for Google's platform, billing, or availability. Your use of the Chrome Web Store is governed by Google's terms, not these Terms.

2.2 Third-Party Services

Certain features may rely on third-party services (e.g., authentication, payment processing). We are not responsible for third-party terms, availability, or performance. Your use of third-party services is governed by their respective terms and privacy policies.

2.3 Electronic Communications

You consent to receive notices and communications from us electronically (including via email, in-product notices, or through your account dashboard), and agree such communications satisfy any legal requirement that they be in writing, to the extent permitted by law. You are responsible for keeping your email address current in your account settings.

You may cancel your subscription at any time via your account settings or by emailing support@recordmybrowser.com with the subject "Cancel Subscription." Cancellations are effective at the end of the current billing period. No partial refunds for unused portions of the subscription period.

If required by California law, we will provide specific pre-renewal disclosures and an online cancellation method. Nothing in these Terms limits any non-waivable rights under the California Consumers Legal Remedies Act, California's automatic renewal laws, or other applicable law.

Fees are exclusive of any taxes, levies, duties, or similar governmental assessments (including, without limitation, sales, use, VAT, or GST). You are responsible for all such taxes associated with your purchase, other than taxes based on our net income.

If you sign up for a trial or promotional offer, your subscription will automatically convert to a paid plan at the then-current rate at the end of the trial or promotional period unless you cancel before conversion. Any specific terms presented with an offer apply in addition to these Terms.

If you provide ideas, suggestions, feedback, or other input regarding the Service ("Feedback"), you grant Carson Fisher LLC a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use and exploit that Feedback without restriction or compensation to you.

The Service may include open-source software components subject to their own licenses. To the extent those licenses conflict with these Terms for such components, those open-source licenses control. A list of open-source components and licenses is available upon request.

9. RECORDING CONSENT AND LEGAL COMPLIANCE

IMPORTANT: You are solely responsible for complying with all applicable recording laws and obtaining necessary consent.

Nothing in this section constitutes legal advice. You are responsible for consulting your own legal counsel regarding applicable recording laws, consent requirements, and privacy regulations in your jurisdiction.

9.5 Regional Variations and International Laws

Recording, eavesdropping, and privacy laws vary not only between U.S. states (e.g., "one-party consent" vs. "two-party consent") but also internationally. You are responsible for understanding and complying with the laws that apply wherever you or your subjects are located at the time of recording. This includes GDPR in the European Union, UK GDPR, and similar data protection frameworks worldwide.

10. PRIVACY AND DATA PROTECTION

Your use of the Service is also governed by our Privacy Policy (https://recordmybrowser.com/privacy/), which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

Important: We do not collect, host, transmit, or have any ability to access your recordings. All recordings remain entirely on your local device unless you explicitly export or share them. Carson Fisher LLC has no ability to view, access, or recover your recordings. You are solely responsible for securing and backing up your recordings.

We are based in the United States. We make no representation that the Service is appropriate or available in every jurisdiction. You access the Service at your own risk and are responsible for compliance with local laws, including data protection and privacy-by-consent requirements (such as GDPR, UK GDPR, and similar frameworks). Notwithstanding Section 17, nothing in these Terms limits any non-waivable consumer rights under the laws of your country of residence.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARSON FISHER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

17. GOVERNING LAW AND DISPUTE RESOLUTION

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. Arbitration shall take place in Kane County, Illinois, shall be conducted in English, and each party shall bear its own costs unless otherwise required by law. Either party may seek temporary or permanent injunctive or other equitable relief in court to prevent or stop unauthorized use, misuse, data-security incidents, or infringement/misappropriation of intellectual property or proprietary rights.

17.3 30-Day Arbitration Opt-Out

You may opt out of the arbitration provisions in Section 17.2 by sending written notice to legal@recordmybrowser.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you are opting out of arbitration. If you opt out, disputes will be resolved in the courts identified in Section 17.5.

You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.

For matters not subject to arbitration (or if you opt out of arbitration), you consent to the exclusive jurisdiction of courts located in Kane County, Illinois.

18. EXPORT CONTROLS AND SANCTIONS

You represent and warrant that you are not (a) located in, organized under the laws of, or ordinarily resident in any country or territory subject to U.S. embargo or trade sanctions, or (b) identified on any U.S. government list of prohibited or restricted parties (including the Treasury Department's Specially Designated Nationals List or the Commerce Department's Denied Persons List). You will not use the Service for any end use prohibited under U.S. or other applicable export control or sanctions laws.

If you are a U.S. government entity, the Service is a "commercial item" as defined in FAR 2.101, and is provided with only those rights as are granted to all other end users under these Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Carson Fisher LLC regarding the Service and supersede all prior agreements and understandings.

21.1 Order of Precedence

If there is a conflict between these Terms and the Privacy Policy regarding the collection, use, or protection of personal data, the Privacy Policy controls. For all other matters, these Terms control.

21.2 Language

These Terms are written and executed in English. If we provide a translation for your convenience, the English version controls to the extent of any conflict or inconsistency.

22. WAIVER

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

23. ASSIGNMENT

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
